Terms of Service
These Terms of Service ("Terms") govern your access to and use of CurAI's website, dashboard, and WhatsApp AI sales agent platform (the "Service"), operated by CurAI ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.
1. The Service
CurAI provides an AI-powered WhatsApp sales and support agent for businesses, including integration with e-commerce platforms (e.g. Shopify) and manual/COD catalog stores, order handling, and related dashboard tools.
2. Accounts
You must provide accurate information when creating an account and are responsible for maintaining the confidentiality of your login credentials and any API keys you connect. You are responsible for all activity under your account.
3. Plans, Billing & Add-Ons
Plans and message add-on packs are activated on request — click a plan or add-on in your dashboard to message our team on WhatsApp, and we will confirm pricing and activate it manually once payment is arranged. Message quotas reset monthly per your active plan. Trial accounts are limited to the free message allowance stated in your dashboard and require approval before going live.
4. Acceptable Use
You agree not to use the Service to:
- Send unsolicited bulk messages (spam) or violate WhatsApp's own Business Messaging Policy.
- Sell illegal goods or services, or misrepresent your business.
- Attempt to interfere with, disrupt, or gain unauthorized access to the Service or other tenants' data.
- Upload content you don't have the rights to, or that is unlawful, defamatory, or infringing.
5. Third-Party Integrations
The Service integrates with third parties (Shopify, BestSmsBulk/Meta WhatsApp Cloud API, OpenAI, and others). Your use of those integrations is also subject to their own terms, and we are not responsible for their availability or performance.
6. AI-Generated Responses
Responses from the AI agent are generated automatically based on the information and catalog you provide. You are responsible for reviewing your catalog/pricing accuracy and for how the agent represents your business. We recommend monitoring conversations, especially early on.
7. Termination
You may stop using the Service at any time. We may suspend or terminate accounts that violate these Terms, abuse the Service, or fail to pay for an active plan.
8. Security
We continuously work to improve the security of the Service, including how account credentials, integration keys, and conversation data are stored and accessed. That said, no online service can guarantee absolute security, and you're responsible for keeping your own login credentials confidential.
9. Disclaimer & Limitation of Liability
The Service is provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law, CurAI and its operators are not liable for any direct, indirect, incidental, special, or consequential damages of any kind — including lost sales, lost profits, lost data, or messages sent or not sent by the AI agent — arising out of or related to your use of, or inability to use, the Service, however caused and regardless of the theory of liability. You use the Service at your own risk.
10. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
